  23. 1:13The real Jay Mac ladies and gentlemen, we are ready to rock and roll with today's edition
  24. 1:16of the program at this very moment.
  25. 1:19Many of you, if not, most of you are making your transition from your part time jobs where
  26. 1:24you generate an income to your full time jobs where you cultivate an outcome.
  27. 1:28And as you do so, I want to remind you to do so with intentionality.
  28. 1:35They're all kind of things happening all over the world.
  29. 1:39I mean, many of you know by now, many of some of you may not know, but Pope Francis passed
  30. 1:46away that announcement took place today.
  31. 1:50Additionally, the head of the World Economic Forum, Klaus Schwab, who originally announced
  32. 1:56his pending resignation, but he announced his resignation is immediate today. Mm hmm. That
  33. 2:05happened today. You also have, and you know, I didn't even pay attention to this over the
  34. 2:13weekend because I had more important things to do, celebrating the resurrection of the
  35. 2:18King of Kings and the Lord of Lords. But what is going on with the United States Supreme
  36. 2:23court. You had a Saturday morning ruling issued an unsigned order. Guys, this is really wacky.
  37. 2:36And unsigned. I have never seen anything like this in my history, in my career as an attorney.
  38. 2:42I know I'm not the most seasoned attorney. I'm not the oldest attorney, not the most experienced
  39. 2:48attorney, but I have never seen the United States Supreme Court issue a ruling on a matter
  40. 2:55that had not even been formally appealed to the US Supreme Court while appeal was pending
  41. 2:59at the Fifth Circuit.
  42. 3:01Yes.
  43. 3:02The court's order specifically says this matter is under consideration at the Fifth Circuit,
  44. 3:07which you'd immediately say, cause one to ask, well why are you talking about it then?
  45. 3:12If it's there, we'll get into that a bit.
  46. 3:16That is swirling.
  47. 3:17But none of those things are more important than what goes on in your home.
  48. 3:24We had the opportunity, the world had the opportunity to celebrate what I believe is the greatest
  49. 3:36event in world history to date.
  50. 3:41That is the resurrection of the Messiah.
  51. 3:44And the reason why I say to date is because the resurrection even points us to an eventual
  52. 3:51occurrence, which is the Lord's return.
  53. 3:54And with that, I want to direct your attention to 1 Corinthians 15.
  54. 4:00This is the time of year, and I have to tell you what a welcome change it is to no longer
  55. 4:11have to deal with the White House saying, let's recognize the transgender day of visibility,
  56. 4:19but to utilize the official platform of the White House to acknowledge the celebration
  57. 4:27of Messiah's resurrection.
  58. 4:301 Corinthians 15 verses 3 through 17.
  59. 4:34I'm gonna take my time and read through this
  60. 4:37because I could not upgrade one centilla
  61. 4:42on what the Spirit of God communicated to us
  62. 4:43through the Apostle Paul.
  63. 4:46He says this,
  64. 4:471 Corinthians 15 verse three,
  65. 4:49for I delivered to you as a first importance
  66. 4:52what I also received,
  67. 4:55that Christ died for our sins according to the Scriptures.
  68. 4:59I want you to note in the Bibles,
  69. 5:01Most English translations have scriptures they're capitalized.
  70. 5:08Verse four, and that he was buried.
  71. 5:13And he was raised on the third day
  72. 5:15according to the scriptures.
  73. 5:19And that he appeared to Cephas and then to the 12.
  74. 5:23And after that he appeared to more than 500 brethren
  75. 5:26at one time, most of whom remain until now.
  76. 5:31But some have fallen asleep.
  77. 5:34Then he appeared to James, then to all the apostles.
  78. 5:38And last of all, as to one untimely born,
  79. 5:41he appeared to me also,
  80. 5:45for I am the least of the apostles,
  81. 5:48and not fit to be called an apostle
  82. 5:50because I persecuted the church of God.
  83. 5:53But by the grace of God, I am what I am,
  84. 5:55and his grace toward me did not prove vain,
  85. 5:59but I labored even more than all of them,
  86. 6:01yet not I, but the grace of God with me.
  87. 6:05whether then it was I or they.
  88. 6:07So we preach and so you believed.
  89. 6:11Now if Christ has preached that He has been raised
  90. 6:14from the dead, how do some among you say
  91. 6:17that there is no resurrection of the dead?
  92. 6:19But if there is no resurrection of the dead,
  93. 6:21not even Christ has been raised.
  94. 6:24And if Christ has not been raised
  95. 6:25and our preaching is in vain,
  96. 6:28your faith also is in vain.
  97. 6:32Moreover, we are even found to be false witnesses of God
  98. 6:35because we testified against God that he raised Christ who he did not raise.
  99. 6:41If in fact the dead are not raised,
  100. 6:43or if the dead are not raised, not even Christ has been raised.
  101. 6:48And if Christ has not been raised, your faith is worthless.
  102. 6:53You are still in your sense.
  103. 6:55Oh man.
  104. 6:59The resurrection of the Messiah is the key
  105. 7:09lynchpin to all that is Christianity.
  106. 7:17The incarnation of our Lord, the virgin birth,
  107. 7:22is in this life.
  108. 7:23Even the crucifixion has no significance
  109. 7:26if he did not raise,
  110. 7:31but it is because of the historical fact
  111. 7:35of the resurrection that we can declare our affinity
  112. 7:40for the blessed hope, the scripture,
  113. 7:47what a treasure, what a treasure.
  114. 7:50The Apostle Paul provides this articulation
  115. 7:53by the Spirit of God.
  116. 7:55You see a consistent feature from all of the Apostles
  117. 7:58of Jesus Christ, which is a glorious,
  118. 8:04gloriously consistent revelation
  119. 8:06throughout the leaders of the Lord's church
  120. 8:08as he established it,
  121. 8:11that the apostles never attempting to separate themselves
  122. 8:14as if they are superior to the household of faith.
  123. 8:20Verse three says,
  124. 8:21for I delivered to you as a first important
  125. 8:24what I also received,
  126. 8:25the exact same thing the apostle Peter says,
  127. 8:27the same things the Lord's apostles say consistently,
  128. 8:31that I am not delivering to you something,
  129. 8:34that I have cherry picked that I'm trying to export
  130. 8:36like some slick oil salesman, I am delivering to you,
  131. 8:40the very thing that I've staked my life and my eternity on.
  132. 8:45Then he goes on to explain that Christ died for our sins
  133. 8:48according to the Scriptures.
  134. 8:52See, the Messianic criterion wasn't just some slip shot,
  135. 8:59cleverly devised tail.
  136. 9:00That's what Peter even says,
  137. 9:01but we're not conveying to convey to you
  138. 9:03some cleverly devised tails.
  139. 9:07I'm articulating that the criteria
  140. 9:09that Yahweh himself established
  141. 9:11is fulfilled in his Messiah,
  142. 9:14because it is fulfilled according to the scripture,
  143. 9:18the scriptures and orderly, historical, foundational,
  144. 9:22criterion that exists that predates the Apostle Paul,
  145. 9:30the simple fact of things like the Septuagint,
  146. 9:33represented by the Roman numerals, LXX,
  147. 9:37is the translation of the 70 rabbinic Jewish scholars
  148. 9:40who sought to make sure that the entire Hebrew scripture
  149. 9:44was available in the common vernacular of the day,
  150. 9:49Remember the succession of global powers from the Babylonians, to the Medes, to the Medo-Persians,
  151. 9:56to the Persians, to the Greeks, and then to the Romans.
  152. 10:00The Roman Empire was a successor to the Greek Empire forged under Alexander the Great, which
  153. 10:07is why the bulk of the New Testament is written in Coinage Greek because it was the language
  154. 10:13that existed in the Grecian Empire, which predated the Roman Empire.
  155. 10:18The translation of the 70, the 70 Jewish elders occurred prior to the anodominy time period,
  156. 10:28which is why we can say without successful contradiction that the Messianic criterion
  157. 10:33was established long before the incarnation never even transpired.
  158. 10:37You don't have someone figuring it out as they go along.
  159. 10:40No, no, no, no.
  160. 10:41This is transpiring Messiah's life, his sinless life, his incarnation, the virgin birth,
  161. 10:47His death is suffering and His resurrection all transpired in fulfillment of Scripture.
  162. 10:58Verse 4 that He was buried and was raised on the third day according to Scripture.
  163. 11:03The book of Ozea, for example, chapter 6, verse 2, the prophet Ozea is in the mid-A
  164. 11:09century B.C. confronting a sinful northern kingdom of Israel.
  165. 11:15and an unique entry is made in verse two.
  166. 11:19That Yahweh will revive us on the third day.
  167. 11:22Oh, that surely couldn't apply to the northern kingdom
  168. 11:28of Israel.
  169. 11:29Yes, Messianic prophecy.
  170. 11:32The gospel of St. Matthew records,
  171. 11:34the wicked Pharisees and Sadducees demanded of Jesus a sign.
  172. 11:39He said, a wicked and perverse generation asked for a sign.
  173. 11:41I give you no sign except for the sign of Jonah.
  174. 11:47This is Jesus harkening back to,
  175. 11:49Jonah chapter one verse 17 referring to Jonah being in the belly of the great fish three
  176. 11:53days and three nights as a mechanism to prophesy his own death and resurrection in his own life.
  177. 12:03The gospel of Mark the gospel of Luke got all declared Jesus distating himself that I
  178. 12:09must suffer and die and I will raise on the third day Jesus and repeatedly.
  179. 12:15There's never been one all of in all of human history.
  180. 12:18not a faith tradition where one claim to be God, predicts his own death, and raises from
  181. 12:24the dead.
  182. 12:25Never happen in the human history except once, which led to the threefold query by C.S.
  183. 12:32Lewis.
  184. 12:33When you have somebody who proclaims themselves to be God, themselves to be God, you only
  185. 12:39have three options.
  186. 12:40They're lunatics.
  187. 12:42They're out of their mind.
  188. 12:43They're crazy.
  189. 12:44But they're just flat liars or they're telling the truth.
  190. 12:50Jesus didn't give us any middle ground to refer to him simply as a moral teacher or as
  191. 12:55a rabbinic scholar, though he was a moral teacher, but more than that.
  192. 12:58Though he was a rabbi, but more than that, then he makes the audacious articulation of
  193. 13:06verse six that the resurrected Christ after he appeared to more than 500 brethren at one
  194. 13:12time.

  196. 13:20Paul is saying, y'all don't have to take my word for it.
  197. 13:24a bunch of other people who saw the same thing. When he describes the resurrected Christ appearing
  198. 13:32to Cephas and then to the 12, that includes Matthias, cross-referenced to Acts chapter 1 verses
  199. 13:3921 through 23 and verse 26, to where the apostles, in order to fill Judas's vacant
  200. 13:47spot, it had to be one who moved in and out among them and saw the Christ walk with the Christ
  201. 13:53as well. Hence Matthias was included to fill the spot. Jesus didn't do this in secret.
  202. 14:02I witnessed this bull witness to it unlike the Quran.
  203. 14:09We learned through history that Muhammad was illiterate.
  204. 14:11So he could not provide an accurate recording of what he
  205. 14:16purported to see in secret, by the way.
  206. 14:17Joseph Smith, same thing.
  207. 14:19It's in secret.
  208. 14:20No, this is brought out in the open.
  209. 14:23And it was all, it all transpired according to scripture.
  210. 14:27And it is because of the resurrection
  211. 14:29that we can lift up holy hands without wrath or doubt.
  212. 14:32It is because of Messiah's resurrection
  213. 14:34that we have the blessed hope of eternal life,
  214. 14:37which is why I know for a fact,
  215. 14:40it's the greatest celebration in the world.
  216. 14:43And I invite you to join me in celebrating
  217. 14:45our Lord's resurrection day by day by day,
  218. 14:49because he is risen indeed.
  219. 14:51And because he is, our lives should reflect that reality.
  220. 14:54But we never grow cold toward this reality.

  233. 15:36with our children and allow them to read the word
  234. 15:40and talk about the wisdom and the counsel,
  235. 15:42the grace that's found there,
  236. 15:44that they can learn to walk in the light
  237. 15:46of the wisdom and the power of your word.
  238. 15:49There's nothing our children need
  239. 15:51more than your precious power forward.

  265. 18:15we look this up during the break,
  266. 18:18there are 1.4 billion people who identify themselves
  267. 18:22as Catholics throughout the world.
  268. 18:26And many of you know I am not Catholic.
  269. 18:33I know we have Catholic listeners,
  270. 18:34we have lots of listeners and viewers who are not.
  271. 18:40But this is, I will be interested to see
  272. 18:46how things fall unfold from here.
  273. 18:48I'll just say it that way.
  274. 18:50I don't think it's a coincidence.
  275. 18:52And frankly, we understand the sovereignty of God.
  276. 18:54You know that there is no sustainous coincidence.
  277. 18:57But I don't think it's coincidental at all that Pope Francis's passage occurred contemporaneous
  278. 19:07to the announcement of the abrupt resignation of Klaus Schwab from the World Economic Forum.
  279. 19:16A lot of people didn't realize until Schmobert unfolded and a lot of you got some of this
  280. 19:25information on this point from this are the Hamilton corner program in particular
  281. 19:31when schmovid and the responses unfolded all around the world. There were lots of people who said
  282. 19:40anybody who said that there's a great reset. That's nothing but a conspiracy theory.
  283. 19:45While at the exact same time you had Klaus Schwab and the World Economic Forum holding conferences on
  284. 19:50what the great reset.
  285. 19:51Klaus Schwab writes a book titled the great reset.
  286. 19:56Klaus Schwab adopted as his personal and the world economic
  287. 20:00forums.
  288. 20:01slogan build back better, which ultimately was whose campaign
  289. 20:07slogan you want to remind me that was?
  290. 20:09Mr. Rosa who's game.
  291. 20:11Oh, that's right.
  292. 20:12Ice cream and Robin Ed Biden.
  293. 20:14His campaign slogan was build back better.
  294. 20:17I played for you the audio of heads of state from all around the world Germany, to France,
  295. 20:26to England, to Canada, all over the world, who was saying things along the lines of build,
  296. 20:33back, better.
  297. 20:34Klaus Schwab wrote an article in 2020, June of 2020, which he said this quote, the world
  298. 20:40must act jointly and swiftly to revamp all revamp all aspects of our societies.
  299. 20:51and economies from education to social contracts and working conditions.
  300. 20:57Every country from the United States to China must participate in every industry,
  301. 21:02from oil and gas to tech must be transformed. In short, we need a great reset of capitalism."
  302. 21:13In quote, while at the exact same time, they had people saying,
  303. 21:17I hate it was a conspiracy theorist. I'm like a conspiracy theorist theorist, all right.
  304. 21:21This is conspiracy you don't want exposed.
  305. 21:25Which every time that term is used it, it always strikes me funny.
  306. 21:28And it's because of my prosecutorial background.
  307. 21:32Because the conspiracy is nothing more than a plan between two or more parties
  308. 21:39to execute a criminal enterprise accompanied by an overt act to bring
  309. 21:46the criminal enterprise into fruition.
  310. 21:48All right.
  311. 21:49That's literally what it is.
  312. 21:51That's literally what it is.
  313. 21:52So if people say conspiracy theories,
  314. 21:53they don't even realize it usually,
  315. 21:55because they're basically saying,
  316. 21:56you're just talking about something that's true,
  317. 21:58that a lot of people don't know about yet.
  318. 22:00Always use the law school hypothetical.
  319. 22:03You have party A, party B and party C,
  320. 22:06who all plan to rob a bank.
  321. 22:08The plan to rob a bank is the plan.
  322. 22:14The activity that allows the plan to move forward to be
  323. 22:18prosecutable as a crime
  324. 22:20is when there's an overt action taken in furtherance of the plan.
  325. 22:24You know, one guy's a muscle, one guy's a getaway driver, one guy is the planner, right?
  326. 22:30He got all of this, the layout of the bank and all this kind of stuff, you know.
  327. 22:34They decided they're going to use a nondescript white van as a getaway truck.
  328. 22:41Well, when one of the parties goes to purchase the white van from Craigslist and they show up with the
  329. 22:48money, that is an overt act taken in furtherance of the plan. So in order to prove the crime
  330. 22:54of conspiracy I try I need to show that there was a plan that included the white van
  331. 22:59and an activity that may very well in and of itself may be viewed to be a legal activity which would be
  332. 23:04the private purchase of a white van but when I can demonstrate that that white van is purchased
  333. 23:09in furtherance of this criminal plan that is what takes it into the incohate crime of conspiracy
  334. 23:16everybody following me on that so when they say oh it's a conspiracy theory well you say whatever
  335. 23:21whatever you want, but I know I know how to read.
  336. 23:25I know how to read old Klaus.
  337. 23:27The booed-back bitter, you know?
  338. 23:31Dude been saying that for like half a decade.
  339. 23:36And so the ones who attempted to
  340. 23:38castigate me as the conspiracy theorist
  341. 23:40only did so, because they objected to me exposing the plan.
  342. 23:43When you got Kaiser Trudeau saying,
  343. 23:45the pandemic gives us an opportunity to advance
  344. 23:48our pre-pandemic priorities.
  345. 23:51What?
  346. 23:53I thought you guys were concerned about people dying.
  347. 23:56talking about opportunity. Oh, huh. Pretty interesting. So when
  348. 24:03you have these two announcements in Klaus Schwab announced his
  349. 24:07intention to resign that was pending, that it was going to
  350. 24:11take effect in 2027. And then today he announces, Oh, no, by
  351. 24:16the way, my my resignation is imminent. Usually, and I don't
  352. 24:20know for a fact in this instance, but usually when things
  353. 24:22like that happen, it's because of a health related concern or
  354. 24:28could be something else.
  355. 24:29And it's not lost on me that the World Economic Forum
  356. 24:32was under scrutiny for allegations in me.
  357. 24:37You cannot make this stuff up, of discrimination
  358. 24:40on the basis of skin color and sexism in the World Economic
  359. 24:44Forum.
  360. 24:44It's almost like the Southern Poverty Law Center
  361. 24:47being accused of the exact same types of things.
  362. 24:50Even the clout swiping itself being accused of inappropriate
  363. 24:55activities at the World Health Organization.
  364. 24:57I just, I, I, having these two announcements on the same day, I just, I just think it's
  365. 25:15noteworthy because a major engine behind the scenes pushing our world toward greater globalistic
  366. 25:26Globalism, greater globalized, regressive notions, all of these things.
  367. 25:35Klaus Schwab was a major force doing it behind the scenes.
  368. 25:43So the question then becomes, and I don't, you know, I don't expect a major
  369. 25:50trajectory change, but the opportunity for trajectory change is upon us.
  370. 26:07I'll leave that right there for now.
  371. 26:11Now I'm going to get to, I mean, this is mind boggling to me.
  372. 26:17This is mind boggling.
  373. 26:18I'm going to do my best to try to cut through the legal ease and communicate what's happening
  374. 26:28here.
  375. 26:29So first, I'll start with the April 7 announcement from the U.S. Supreme Court in the Trump versus
  376. 26:35J.G.G. case.
  377. 26:37This is where all the media is up in arms about the, there's a man who was deported
  378. 26:43to El Salvador, you know, illegally.
  379. 26:46And I'm just like, and I know people, you know,
  380. 26:50you don't trust the government, you know, whatever.
  381. 26:56Oh yeah, that's another component of, you know,
  382. 27:00the world economic forums deal population control.
  383. 27:03That's another part of their deals, you know?
  384. 27:07I've always said it, not all climate zealots
  385. 27:13ballots are population control alarmists. But all population control alarmists happen to
  386. 27:20be climate zealots. Isn't that an interesting phenomenon? But getting back to this, so the
  387. 27:25April 7 decision, the court ruled that the Trump administration had no lawful obligation
  388. 27:36to bring this person back. And I should have put this audio up because the wife of the guy
  389. 27:45Omar, how you pronounce his last name?
  390. 27:48Garcia, Abrego Garcia, yes.
  391. 27:51His wife was interviewed by Michael Strahan
  392. 27:53on Good Morning America.
  393. 27:55And Michael Strahan asked her directly,
  394. 27:56has he beat you before?

  413. 28:50Guys, this is all in the record of his asylum claim in America was due to the threat of
  414. 28:58what was recorded as a rival gang.
  415. 29:04A rival gang.
  416. 29:10So that means this is in his asylum claim.
  417. 29:15It's a rival gang which confirms that he was a what?
  418. 29:24A gang member.
  419. 29:29It's just and you have in it this this is one of the things
  420. 29:35It's just I have no desire to be a partisan gang banger. No desire
  421. 29:45none
  422. 29:46when you see people like senator Chris Van Hollen who had all manner of
  423. 29:52constituents in his own state
  424. 29:55who had family members murdered by illegal aliens
  425. 30:02Some members of the very gang that a brago Garcia is supposed to be a part of
  426. 30:07He never had a phone call with any of these families, never once met any of these families,
  427. 30:18never once traveled to his own district to talk to his own constituents, to try to serve
  428. 30:22as a source of consolation and soul as for them.
  429. 30:26But he'll hop a plane and go to El Salvador.
  430. 30:31And this is like, you cannot make this stuff up.
  431. 30:33It's like, in what world do you find yourself funnier minded?
  432. 30:37That is the appropriate trajectory to pursue.
  433. 30:41Put it out aside for the moment.
  434. 30:43So the April 7th decision placed no obligation on the Trump administration to do anything
  435. 30:53in return.
  436. 30:54The major thing, and I shared it on this show, is that they concluded detainees, illegal immigrant
  437. 31:03detainees who wanted to object to their removal from the country had to do so under the writ
  438. 31:11of habeas corpus because their legal remedies were confined to habeas corpus actions, then
  439. 31:22they had to do so in the jurisdiction where they were detained.
  440. 31:25Remember that we talked about this.
  441. 31:27So you can't follow suit in DC to challenge your detention, which they were arguing, well,
  442. 31:32we're not challenging the detention.
  443. 31:33We could stay in custody, but we just don't want to be moved out of the country.
  444. 31:37That's literally what they were arguing, which causes illegal question is whether or not because
  445. 31:42The habeas is a remedy for detention itself, not merely for removal.
  446. 31:48And you also have the very narrow application of challenging removal under the Alien Enemies
  447. 31:52Act.
  448. 31:53The Alien Enemies Act is a tool in the toolbox to deport illegal aliens, but it's not the
  449. 31:57exclusive one.
  450. 32:00Okay?
  451. 32:02So, that decision said habeas actions must be brought in the jurisdiction where the detainees
  452. 32:09are physically.
  453. 32:11led to Venezuelan illegal aliens who were in prison who were detained not
  454. 32:17prison but detained being represented by a host of regressive lawyers ACLU and
  455. 32:21things of that nature in that interest they don't know another story but they
  456. 32:26filed petitions to challenge their removal in the northern district of Texas
  457. 32:32where they physically are all right a temporary restraining order was sought
  458. 32:38in Texas to stay their removal. The district court was considering the matter
  459. 32:46and an emergency appeal was made to the Fifth Circuit Court of Appeals. I'll pick
  460. 32:50up from there when we come back on the other side of the brink. We're going to
  461. 33:01talk about this further issue. Our response who's behind this.

  481. 34:14Welcome back to the Hamilton Corner, Abraham Hamilton III.
  482. 34:17I'm going to continue trying to make this playing for you.
  483. 34:20So following the April 7th ruling to where the Supreme Court said that detainees who wanted
  484. 34:26to challenge their removal, they had to do so as a habeas petition in the jurisdiction where
  485. 34:30they were physically being detained.
  486. 34:32All right.
  487. 34:33And then the court also said that detainees, illegal immigrant detainees were required to
  488. 34:39be given notice of their removal dates, meaning deported deportation dates and an opportunity
  489. 34:49to be heard concerning that challenge.
  490. 34:50Said nothing about the duration of things of that nature.
  491. 34:53All right.
  492. 34:54So following that you had several individual, Venezuela, illegal immigrant detainees who
  493. 35:04the United States government has identified as members of the gang, Trender, Aragua, Trender,
  494. 35:12De Aragua. Similar to MS-13, classified as a terrorist organization. All right, they
  495. 35:22sought to challenge their removal from the United States of America and the United States
  496. 35:28District Court for the Northern District of Texas. The District Court judge there judged
  497. 35:35James Wesley Hendricks, who is a Trump appointee, by the way, rejected the request for the temporary
  498. 35:41restraining order. All right, say that there's no basis for it because he stated in his ruling,
  499. 35:53quote, the government's general representations about the procedures necessary in these cases,
  500. 35:58and the broader group of Venezuelan detainees is likely not facing an imminent threat. So there
  501. 36:05There was no reason for a temporary restraining order prohibiting the government from being
  502. 36:12able to remove them.
  503. 36:13All right.
  504. 36:14So the TRO, the temporary restraining order, there's no basis for it.
  505. 36:21They immediately appealed this to the Fifth Circuit Court of Appeals.
  506. 36:28But you had the additional unique feature.
  507. 36:31Guys, this all happened on April 16th, by the way.
  508. 36:38We have the unique feature where the appeal to the Fifth Circuit somehow included, I don't
  509. 36:44know how you do this, a magical appeal to the US Supreme Court at the same time.
  510. 36:55Now I just look, this is some basic constitutional law.
  511. 36:59This is like con law foundational.
  512. 37:03The United States Supreme Court has original jurisdiction in a very, very narrow sect of
  513. 37:08cases dealing with foreign ambassadors, things of that nature.
  514. 37:11Otherwise in order for a matter to come before the US Supreme Court, it has to be an appeal
  515. 37:16from a lower court, from a lower court decision.
  516. 37:21You might have heard about this.
  517. 37:22There's an entire level of courts in the United States of America's federal system called
  518. 37:26appellate courts, right?
  519. 37:31Appellate courts here appeals from district courts, the US Supreme Court in order to hear
  520. 37:43Um, a matter within its appellate jurisdiction does so historically constitution and traditionally
  521. 37:49procedurally on appeal from the appellate courts. But in this instance, before the United States,
  522. 38:01appellate court for the Fifth Circuit even rendered a decision, guys, I, I kid you not before the
  523. 38:09the United States appellate court or the fifth circuit even rendered a decision.
  524. 38:16And I know because of the motions filed on things of that nature.
  525. 38:23Justice Samuelito and his dissent said it was only eight hours after the appeal even reached
  526. 38:29the Supreme Court until they entered this order.
  527. 38:33And there were no appellate documents filed in the fifth circuit yet from the Trump administration,
  528. 38:37let alone the US Supreme Court.
  529. 38:40So this US Supreme Court way into this matter with hearing nothing from the Trump administration.
  530. 38:49Can you believe that?
  531. 38:50These are the kinds of things I expect to happen to Venezuela.
  532. 38:53I don't expect these kinds of things that happen in the United States of America, but
  533. 38:57that is what happened.
  534. 38:58So shortly after midnight, Saturday morning, Friday night into Saturday morning, the United
  535. 39:04States Supreme Court issued, and I'm going to read this to you, it's literally one paragraph
  536. 39:08one sentence about five sentences total, an unsigned, unnamed opinion. And the order literally says this,
  537. 39:15quote, there is before the court an application on behalf of a putative class of detainees. I'm
  538. 39:20going to explain that a putative class of detainees seeking an injunction against their removal under
  539. 39:26the Alien Enemies Act. The matter is currently pending before the Fifth Circuit. Upon action
  540. 39:33by the Fifth Circuit, the solicitor general is invited to file a response to the application
  541. 39:37before this court as soon as possible.
  542. 39:41The government is directed not to remove any member
  543. 39:44of the putative class of detainees
  544. 39:47from the United States until further order of this court.
  545. 39:50Justice Thomas and Justice Alito dissent
  546. 39:53from the court's order statement from Justice Alito
  547. 39:56to follow.
  548. 39:58Let me break this down a little bit.
  549. 40:01First, that, no by the way, that was the entire order.
  550. 40:04That was issued Saturday morning,
  551. 40:07after midnight, Friday night.
  552. 40:09That was the entire order.
  553. 40:11We know it's seven to two because only two people
  554. 40:13to descend from the decision was Justice Alito
  555. 40:15and Justice Clarence Thomas.
  556. 40:17This happened so fast, Justice Alito didn't even have
  557. 40:20a dissent written.
  558. 40:22Just noted, I'm gonna write a dissent later to this.
  559. 40:27When you consider this came out in the we hours
  560. 40:30of Saturday morning, you understand why he hadn't written
  561. 40:31anything yet.
  562. 40:37So the court entertained an application
  563. 40:41on behalf of a putative class,
  564. 40:42guys, let me explain what that means.
  565. 40:44A putative class is a group of people that are attempting
  566. 40:47to assert class action litigation,
  567. 40:49but a class hasn't even been defined yet.
  568. 40:51So the group of people who's actually sure
  569. 40:53it hadn't even been defined yet.
  570. 40:55It's an answer group that we will figure out
  571. 40:57who all fits in this group later.
  572. 40:59The application to define a class for class action purposes
  573. 41:03said people being detained currently
  574. 41:07under the authority of the Alien Enemies Act
  575. 41:10and those who might be detained in the future.
  576. 41:13So it's an undefined, unspecified group of people,
  577. 41:18Yet the Supreme Court ruled.
  578. 41:20That's the first point I wanna make.
  579. 41:22Secondarily, this sentence,
  580. 41:24the matter is currently pending before the Fifth Circuit.
  581. 41:27Well, if the matter is pending before the Fifth Circuit,
  582. 41:29why is the US Supreme Court weighing in on it?
  583. 41:33Why is the Supreme Court weighing in on it
  584. 41:36if it's pending at the Fifth Circuit?
  585. 41:39There's no original jurisdiction
  586. 41:40before the Supreme Court for this case.
  587. 41:43There certainly is an appellate jurisdiction
  588. 41:44because the order you issued
  589. 41:46saying that the matter is currently pending.
  590. 41:49And oh, by the way, after this order was issued,
  591. 41:52the Fifth Circuit Court of appeals said,
  592. 41:53we can't rule on this now,
  593. 41:55because the Supreme Court has stepped in.
  594. 41:56They have taken jurisdiction from us.
  595. 42:00Which is right.
  596. 42:03So that literally effectively says,
  597. 42:05you can't even appeal this issue to the Supreme Court,
  598. 42:08because there's no appellate record
  599. 42:10that's even been established at the Fifth Circuit.
  600. 42:14Then get this sentence.
  601. 42:15Upon action by the Fifth Circuit,
  602. 42:16the solicitor general,
  603. 42:19who is the person who's representing
  604. 42:20the Trump Administration before the Supreme Court,
  605. 42:23is invited to file a response to this application as soon as possible.
  606. 42:29Get this guys.
  607. 42:29I want to make this plane.
  608. 42:31That's like putting it in Bobby in terms of me and Bobby, right?
  609. 42:38Bobby, Bobby's going to be the home team on this.
  610. 42:42Bobby has filed an appeal to the Supreme Court, to the Fifth Circuit,
  611. 42:46and to the Supreme Court.
  612. 42:47I haven't even weighed in to the Fifth Circuit yet, but Bobby's already getting
  613. 42:51an answer from the Supreme Court.
  614. 42:52And the Supreme Court tells me and you file your response when the Fifth Circuit
  615. 42:57answers Bobby's request.
  616. 42:58That makes you want to cart before the horse is absolutely right and
  617. 43:06Then without having a pewative class defined
  618. 43:10Without having any appellate record remember the Trump administration had no opportunity to say anything before the fifth circuit or the Supreme Court
  619. 43:17By the time this order was issued
  620. 43:20Yeah, the Supreme Court says by the way the Trump administration is directed not to remove any member of the pewative class of detainees
  621. 43:26From the United States until further order further order of this court now
  622. 43:29Now here's the major thing, the Alien Enemies Act is one law.
  623. 43:33That's not the only law that provides the basis for removing illegal aliens.
  624. 43:37So the Supreme Court just said you can't deport anybody.
  625. 43:41It doesn't limit it to the Alien Enemies Act.
  626. 43:46It just said you can't deport anybody until we say something else on this matter.
  627. 43:55That's unconstitutional.
  628. 43:57Hence, Justice Samuel Lili Alito's dissent, which he was joined only by Justice Clarence
  629. 44:07Thomas, not surprisingly, which he says this, and I'll just direct you to the last paragraph
  630. 44:11of his dissent.
  631. 44:12He said, quote, in sum, literally in the middle of the night, the court issued unprecedented
  632. 44:18and legally questionable relief without giving the lower courts a chance to rule without
  633. 44:24hearing from the opposing party within eight hours of receiving the application with dubious
  634. 44:29factual factual support for its order and without providing any explanation for its order.
  635. 44:34I refused to join the court's order because we had no good reason to...
  636. 44:39No, I'm sorry again.
  637. 44:41I refused to join the court's order because we had no good reason to think that, under the
  638. 44:45circumstances, issuing an order at midnight was necessary or appropriate.
  639. 44:51Both the executive and the judiciary have an obligation to follow the law.
  640. 44:57The executive must proceed under the terms of our order in Trump versus JGG.
  641. 45:02That's the April 7th case.
  642. 45:04And this court, meaning the US Supreme Court should follow established procedures.
  643. 45:09Guys, that means Justice Amy Coney Barrett.
  644. 45:14That means Justice Brent Kavanaugh.
  645. 45:16That means Chief Justice John Roberts joined with Justice Elena Kagan.
  646. 45:22to Sonya Sotomayor, Justice, I don't know what a woman is.
  647. 45:26Katanji Brown Jackson to say that even though there is no appellate record in the Fifth Circuit
  648. 45:33hadn't ruled, we decided to step in and say that you can't rule.
  649. 45:37Guys, this, I've never seen anything like this in my life.
  650. 45:39And what the feeling that I have, the feeling that I have is that those seven justices on
  651. 45:47the Supreme Court are attempting to flex their muscle to try to say, we have this authority.
  652. 45:53And I just simply, you know, respectfully as an agent of the bar as a member of the legal
  653. 46:06environment in our nation to say this is an unconstitutional action.
  654. 46:12So now let me say this, it is true that this is all concerning a temporary restraining order.
  655. 46:20That is true.
  656. 46:22I have never seen the Supreme Court interject when you haven't even had a full, a full
  657. 46:29appellate record, let alone any briefing done.
  658. 46:34It's like they literally just taking the word of the lawyers for the trend that I want members.
  659. 46:45Man, I'm telling you, can't I make this stuff up?
  660. 46:48This is just the thing that I got members argued that they have these rights.
  661. 47:01And even if the Trump administration gave them notice of the deportation, they gave them
  662. 47:05notice only in English when they only speak Spanish.
  663. 47:09I'm not kidding.
  664. 47:10Y'all going, y'all can go look this up for yourself.
  665. 47:12They got noticed, but it was, it was, it was in English.
  666. 47:16I'm not joking.
  667. 47:19Y'all, I'm serious.
  668. 47:20As one of the arguments that they made.
  669. 47:21The other thing was that the lawyers were lawyers for only a few of the men, not everybody detained
  670. 47:28in there.
  671. 47:29So the US Supreme Court didn't narrow their order even to the ones who are actually parties
  672. 47:34that are represented by these attorneys.
  673. 47:35They extended their order to the entire punitive class.
  674. 47:39How do you do that when a class hasn't even been defined?
  675. 47:45That's literally said like five or six people have this class, this claim.
  676. 47:49Now we know there's about another 25 or 30 that could have the same claim.
  677. 47:54So we're going to make this ruling apply to all 25 or 30.
  678. 47:58Its weight is likely more than that.
  679. 48:00But I'm just explaining how do you do that?
  680. 48:04This is a full on, full on, and I know this word is thrown out, I believe a bit too casually.
  681. 48:15This is presenting a full on constitutional crisis.
  682. 48:21What are the powers that the court has?
  683. 48:25How can you weigh in on an issue that's not even properly before you?
  684. 48:29And then remember, remember when the litigation concerning the 2020 election came, how often
  685. 48:35do the courts say, well, this is not properly before us?
  686. 48:38We don't have standing for this.
  687. 48:39Yet they'll jump into this?
  688. 48:41Guys, I'm just, maybe it's because I'm gonna turn into this is standing out to me, but this
  689. 48:47is this is egregious.
  690. 48:50And I feel like it is a tug of war between the executive branch and the judiciary based
  691. 48:56on this ruling seven out of the nine Supreme Court justices.
  692. 49:00A tug of war as to what power they actually have.
  693. 49:07This is extreme guys.
  694. 49:11How do you weigh in?
  695. 49:12There's not even an appellate record.
  696. 49:16on Saturday about 11 p.m. the solicitor general is finally able to file his brief in which he
  697. 49:26objects to what the court stated but he's objecting to what they've already done not to
  698. 49:31what is being argued. I'm going to continue to follow this and bring you more updates as
  699. 49:36it unfolds. God bless you all.
